What Does the County Surrogate Do?
The county Surrogate is an elected official who serves as judge of the Surrogate’s Court in uncontested probate and estate matters. The office also performs filing and clerk functions for the Superior Court. The New Jersey Judiciary’s explanation of the county Surrogate describes these distinct roles.
For adult guardianship, filing papers with the Surrogate does not mean that the Surrogate independently determines incapacity. A Superior Court judge decides the application; the Surrogate’s office handles the relevant filing and qualification functions.
